General terms and conditions
1. Introduction
This document describes the terms and conditions of use for SustainDeals' services (“Services”). By accessing or using the Services, you agree to be bound by these terms and conditions. These terms and conditions may only be modified with the written consent of an authorized representative of SustainDeals. SustainDeals reserves the right to modify this agreement at any time without prior notice. It is the user's responsibility to review these terms and conditions periodically for changes. SustainDeals will endeavor to notify you of any material changes to the agreement. Continued use of the Services after the effective date of any changes constitutes acceptance of the updated terms and conditions. Users who do not agree to the modified terms and conditions must discontinue use of the Services.

2. Eligibility criteria for using the SustainDeals.com platform
SustainDeals services are exclusively reserved for individuals with the legal capacity to enter into contracts. Users must be of legal age and possess the legal capacity required to use the SustainDeals platform's features. SustainDeals reserves the right to refuse its services to individuals or entities who, in its sole discretion, are likely to harm the SustainDeals website.
3. Services
SustainDeals offers various free services, such as browsing, searching, and registration. SustainDeals also offers a range of paid services, including online advertising, classified ads, and subscriptions. SustainDeals provides a platform that allows users to post, sell, find buyers, and/or purchase laboratory, scientific, and related equipment worldwide, in various formats: fixed price, auctions, and classified ads.
SustainDeals only provides a service connecting buyers and sellers. Transactions made through SustainDeals are conducted directly between the buyer and the seller (except for items sold by SustainDeals, as indicated in the item description). In the event of a dispute with one or more users, SustainDeals (its officers, directors, agents, employees, and subsidiaries) is not liable for any claims, demands, or damages (direct and indirect) of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes. SustainDeals is only liable for items sold directly by SustainDeals. Buyers can verify that an item is sold by SustainDeals by checking the product description for the phrase "Item sold by SustainDeals."
4. Schedule of fees and commissions
SustainDeals reserves the right to change its prices at any time without prior notice. Users will be notified of any price changes before they take effect. By continuing to use SustainDeals services after this notification, users accept the new prices. Unless otherwise stated, all SustainDeals service prices are listed in Swiss francs. Users are responsible for paying all applicable fees and taxes related to the use of SustainDeals services.
Commissions and transaction fees may be collected at the time of the transaction, charged after a predetermined period, or billed directly to the seller monthly. The terms of this collection period are subject to change at SustainDeals' discretion.
Transactions made through SustainDeals may be subject to additional commissions or transaction fees, as per our fee schedule. These fees are non-refundable.
5. Accuracy, condition, legality and safety of the items sold
It is important to note that SustainDeals has no control over the quality, safety, or legality of the items offered for sale. Furthermore, SustainDeals is unable to verify the accuracy of listings, the sellers' ability to sell items, or the buyers' ability to make purchases.
SustainDeals and its suppliers offer their website and services "as is," without any express, implied, or statutory warranties or conditions. SustainDeals and its suppliers expressly disclaim all implied warranties of title, merchantability, fitness for a particular purpose, and non-infringement.
SustainDeals and its suppliers shall not be liable for any loss of profits or any special, incidental or consequential damages arising out of or in connection with the site, services or this agreement, including in cases of negligence.
6. Payment processing and associated fees
In this context, SustainDeals acts solely as an intermediary between buyers and sellers. SustainDeals disclaims all responsibility for the processing of payments between the parties. Sellers receive payments directly from buyers, and SustainDeals does not intervene in the transaction process. By conducting transactions on SustainDeals, users agree to release SustainDeals from all liability related to payment processing and VAT.
Furthermore, it is the sole responsibility of the sellers to confirm and invoice the buyer for the applicable sales tax, in accordance with the law. SustainDeals does not provide any sales tax advice or support; therefore, sellers are advised to consult a tax expert or the relevant authorities to ensure their compliance with tax regulations.
Transactions made through SustainDeals may be subject to processing fees charged by our third-party payment service providers. SustainDeals is not responsible for these fees and cannot waive or refund them. Applicable fees are subject to change according to the terms and conditions set by our third-party payment service providers. Users are responsible for verifying the fees and commissions associated with their payments.
7. Cancellations, returns and refunds
SustainDeals is not responsible for handling cancellations, returns, or refunds. All cancellation or refund requests must be directed to the seller. SustainDeals cannot guarantee that a seller will be able to issue a refund or accept a return after purchase. For any questions regarding a seller's return or cancellation policy, please contact them directly or consult their return policy listed on their profile.
8. User authentication and security
Given the inherent anonymity of the internet, verifying the identity of each user can be complex, or even impossible in some cases. SustainDeals encourages direct communication between users through the tools available on our site to promote transparency and trust.
To enhance transaction security, SustainDeals strongly recommends using third-party payment or escrow services when dealing with unknown individuals or companies. These additional measures provide increased protection against potential risks.
SustainDeals has no control over the information provided by users and made available through its system. Be aware that other users' information may be offensive, harmful, inaccurate, or misleading. Exercise caution, common sense, and sound trading practices when using the SustainDeals website.
SustainDeals reserves the right to suspend or terminate a user account in the event of suspected fraudulent activity. All reports of fraudulent behavior on SustainDeals are thoroughly investigated and taken very seriously.
To facilitate connections between users and potential sellers, SustainDeals may send general information requests to sellers on the platform. These requests, submitted through the relevant category pages, are not linked to specific listings. SustainDeals reserves the right to direct these requests to specific sellers as it deems appropriate. General information requests are included in the relevant reports provided to sellers.
9. Seller's responsibility for the security of user information and accounts
As a SustainDeals seller, you may have access to certain personal information of users, including their names, email addresses, shipping information, and other contact details necessary to complete transactions. By using the SustainDeals platform, you acknowledge and agree to the following:
1. You are solely responsible for the protection and security of your SustainDeals account, including personal data obtained through it.
2. You must take all reasonable precautions to prevent any unauthorized access, use or disclosure of personal information obtained through the SustainDeals platform.
3. SustainDeals disclaims all liability for consequences resulting from the loss, theft or compromise of this information due to a seller's failure to secure the account.
Failure to comply with this obligation may result in the suspension or termination of your seller account, as well as possible legal consequences in accordance with applicable privacy and data protection laws.
10. Solicitation
The SustainDeals system is designed to facilitate the open exchange of various types of industrial and scientific equipment, supplies, and products. However, any use of the SustainDeals system for purposes contrary to the interests of SustainDeals and its users is strictly prohibited.
SustainDeals users who engage in prohibited solicitation activities, including referring users to competing websites, will be held liable for any damages suffered by SustainDeals and may be suspended from the platform.
The classified ads on SustainDeals are exclusively for individuals or businesses seeking instruments or products for their own use. They must not be used to drive traffic to external websites or to promote commercial activities. Sellers are encouraged to browse the SustainDeals platform to find items available for resale or commercial purposes.
Listings in the "Wanted" category must be for scientific, medical, or test/measurement instruments, equipment, accessories, or products, or any other industrial equipment. Any listing that does not meet this criterion will be removed from the SustainDeals system without notice.
SustainDeals reserves the right to approve or reject a search ad for any reason deemed appropriate, without providing explanation or prior notice.
It is agreed that no robot, spider, communication device, or manual process will be used to monitor or copy the web pages or content of SustainDeals without prior written authorization from SustainDeals. Any disruption to the proper functioning of the SustainDeals website or any ongoing sale, through the use of devices, software, or routines, is strictly prohibited. Users agree not to undertake any actions that impose an unreasonable or disproportionate burden on the SustainDeals infrastructure. Users agree not to copy, reproduce, alter, modify, create derivative works from, or publicly display any content from the SustainDeals website without prior written authorization.
11. Guidelines for announcements and related information
The listing must include a complete description of the item, as well as all terms of sale. It may include text descriptions, graphics, images, and any other relevant content. It is imperative that each item be categorized. If no category is selected, SustainDeals reserves the right to categorize the item as it deems appropriate.
It is the sole responsibility of sellers to ensure they hold all necessary rights, licenses, and permissions to use and submit any content they post on SustainDeals, including text, images, logos, trademarks, and other intellectual property. By submitting content to SustainDeals, you represent and warrant that you own the content or have obtained all necessary rights to it, and that its use on SustainDeals does not infringe upon the rights of any third party.
By submitting content to SustainDeals, you grant SustainDeals a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and distribute that content in its marketing materials, promotional resources, and other communications. This includes, but is not limited to, its use on our website, social media channels, newsletters, and other materials associated with brands affiliated with the SustainDeals Group. SustainDeals will endeavor, to the extent possible, to attribute the content to its original creator, in accordance with its Privacy Policy.
The use of hyperlinks in SustainDeals ads is reserved exclusively for active SustainDeals advertisers and requires the explicit consent of SustainDeals. Any ad containing a hyperlink will be deactivated or removed immediately and without notice. For more information regarding the use of hyperlinks in ads, please contact SustainDeals customer support.
Price manipulation is strictly prohibited on SustainDeals. If SustainDeals detects that a user has manipulated or attempted to manipulate the final selling price of an item, their account will be immediately suspended from the SustainDeals system without prior notice.
SustainDeals can provide shipping cost estimates for listings from multiple carriers. However, it's important to understand that these rates are estimates based on information provided by the seller. SustainDeals cannot guarantee the accuracy of these estimates and is not liable for any discrepancies between estimated and actual shipping costs. Please note that the shipping, handling, and processing of any purchased item are the sole responsibility of the seller. Buyers are advised to verify shipping costs directly with the seller before completing the transaction.
SustainDeals allows you to view item prices in multiple currencies. However, it's important to note that SustainDeals does not manage any exchange rates for items purchased through its platform. These fees may vary depending on the third-party payment provider used, the payment method, and the exchange rate at the time of the transaction.
12. Confidentiality
SustainDeals places great importance on respecting the privacy of its users. Users may occasionally receive communications regarding SustainDeals services or offers from third parties, with the option to opt out. SustainDeals may disclose information to the relevant authorities in the event of suspected illegal activity. The current privacy policy is available on the SustainDeals website.
SustainDeals may allow users to submit comments, ratings, or reviews about their experience with the platform or a particular seller. No SustainDeals user should use these features to harm the integrity of the platform or manipulate a seller's rating or overall perception. SustainDeals cannot moderate or verify information submitted through these features. Once submitted, comments and ratings are permanent and will not be removed or modified by SustainDeals, except in exceptional circumstances or in cases of proven fraud.
13. Penalties
In addition to other potential sanctions, SustainDeals may issue warnings, temporarily or indefinitely suspend membership, or terminate it and refuse services in the event of a breach of this agreement or related documents, failure to verify or authenticate the information provided, or if a user's actions may give rise to legal liability.
14. Final Notes
This contract is governed by Swiss law.
SustainDeals does not guarantee uninterrupted access to the services. If any provision is deemed invalid, the remaining provisions shall remain in full force and effect. This agreement constitutes the entire agreement between the parties. SustainDeals reserves the right to assign this agreement in the event of a merger or acquisition.
Users agree to indemnify and hold harmless SustainDeals, its parent company, subsidiaries, affiliates, officers, directors, agents and employees from and against any and all third-party claims or demands, including reasonable attorneys’ fees, arising out of any breach of this agreement or related documents, or any violation of law or third-party rights.
All users must comply with applicable national and international laws, statutes, ordinances, and regulations regarding the use of the service and transactional activities.
This agreement does not create any agency, partnership, joint venture, employer-employee or franchisor-franchisee relationship between users and SustainDeals.
